Right to Self-Determination

The right to self-determination is common Article 1 of both Covenants — the right of all peoples to freely determine their political status and pursue their economic, social and cultural development. Its prominence (placed as Article 1) marks it as a foundation for all other rights.

Distinguish two forms:

  • External self-determination — the right of a people to independence or freedom from colonial or alien domination (the decolonisation context).
  • Internal self-determination — the right of a people to genuine self-government, participation and autonomy within an existing State.

Modern international law strongly supports the internal form and the external form in the colonial context, but resists a general right of secession that would break up existing States.

🧩 WORKED EXAMPLE — internal vs external

Facts. A regional group claims a right to secede and form its own State.

Rule. External self-determination is recognised mainly for colonial/oppressed peoples; otherwise the right is internal (self-government within the State).

Apply. Absent colonial domination, the group’s claim points to internal autonomy and participation, not a general right to break away.

Conclusion. Self-determination usually means meaningful self-government inside the State, not automatic secession.

ICCPR & ICESCR, common Article 1(1): “All peoples have the right of self-determination. By virtue of that right they freely determine their political status and freely pursue their economic, social and cultural development.”

In Simple Terms: Peoples have the right to shape their own political and economic future — usually through self-government inside a State, and, in the colonial context, through independence.
