The European Social Charter (1961, revised 1996) is the Council of Europe’s counterpart to the ECHR: where the ECHR guards civil and political rights, the Social Charter guards economic and social rights.

Rights protected — the right to work, to just and safe working conditions, fair remuneration, to organise and bargain collectively, to social security, to health and to social and medical assistance.
Supervision — by the European Committee of Social Rights, mainly through a system of periodic State reports, and through a collective complaints procedure (1995 Protocol) by which trade unions and NGOs may complain of non-compliance.

It is the ECHR’s twin: two Charters of the Council of Europe, one for liberty rights, one for social rights.

🧩 WORKED EXAMPLE — Charter vs Convention

Facts. A worker’s collective-bargaining right is denied in a European State.

Rule. Labour and social rights fall under the European Social Charter (supervised by the Committee of Social Rights), not the ECHR’s individual-petition Court.

Apply. The complaint proceeds through State reporting or the collective-complaints procedure to the European Committee of Social Rights.

Conclusion. The Social Charter, not the ECHR, is the correct instrument for a social-rights claim.

European Social Charter, 1961, Part I, para 5: “All workers and employers have the right to organise in national or international organisations for the protection of their economic and social interests.”

In Simple Terms: If the right in question is about work, unions or welfare rather than liberty or a fair trial, it lives in the Social Charter and is policed by reports and collective complaints, not by the Strasbourg Court.
