Facts.

Gerard Lawless, suspected of IRA membership, was detained without trial under Irish emergency legislation. He complained to the Strasbourg institutions that his detention breached Articles 5 and 6 of the ECHR.

Issue.

Could a State lawfully detain without trial by derogating from the Convention under Article 15 during a public emergency?

Held.

Yes. Ireland faced a genuine “public emergency threatening the life of the nation,” the derogation was validly declared, and the measures were strictly required. The first-ever judgment of the European Court.

Why it matters.

It set the framework for emergency derogations — the test every terror-detention problem still turns on: a real emergency, a formal derogation, and measures strictly required.
