Facts.

A husband obtained a divorce decree from a foreign court that had no real jurisdiction over the parties and misrepresented his domicile.

Issue.

Is such a foreign divorce conclusive in India under s.13?

Held.

The decree was not recognised — the foreign court was not a court of competent jurisdiction over the parties, so exception (a) of s.13 applied.

Why it matters.

An early, much-cited application of the “competent court” and fraud exceptions in s.13 (Topic 6).
