Facts.
Parties sought to keep a mortgage claim alive by relying on an acknowledgment, but the acknowledgment had been made after the limitation period had already run out.
Issue.
Can an acknowledgment made after the prescribed period has expired revive a time-barred right or debt under s.18?
Held.
An acknowledgment can extend limitation only if made before the period expires. An acknowledgment made after expiry cannot revive a right or debt that is already time-barred.
