PPV&FR Authority — Powers and Functions; National Register

Every registration system needs a keeper of the register and a decider of disputes. For plant varieties that is the PPV&FR Authority in New Delhi, and the book it keeps is the National Register of Plant Varieties. Because the Authority takes decisions affecting valuable rights, it must act fairly — which is why the “cancelled without reasons” problem keeps appearing.

The Authority and the Register

A. Constitution — s.3

The Protection of Plant Varieties and Farmers’ Rights Authority is established under s.3 as a statutory body, with headquarters at New Delhi. It consists of a Chairperson and fifteen members representing the relevant ministries, agricultural universities, seed industry, farmers, women’s organisations and tribal groups. A Registrar-General heads the Registry.

B. Functions — s.8

Under s.8, the Authority shall:

Register plant varieties and maintain the National Register.
Promote and develop new varieties and protect the rights of breeders and farmers.
Ensure quality seed availability and characterisation/documentation of varieties.
Provide for benefit-sharing, compensation and the Gene Fund, and preserve plant genetic resources.

C. Powers

The Authority has the powers of a civil court (summoning, evidence, discovery) for its inquiries, and may register, refuse, or cancel registrations — but must observe natural justice (a hearing and reasons) before an adverse order.

D. The National Register of Plant Varieties — s.13

The National Register (s.13) records the names of registered varieties, the names of breeders/owners, the essential characteristics, and denominations. It is the public record of who owns what, maintained by the Registrar.

Section 8(1): “It shall be the duty of the Authority to promote, by such measures as it thinks fit, the encouragement for the development of new varieties of plants and to protect the rights of the farmers and breeders.”

In Simple Terms: The Authority registers varieties, keeps the National Register, and runs the benefit-sharing/Gene-Fund machinery. Because its orders affect property rights, it must give a hearing and reasons before refusing or cancelling.

🧩 WORKED EXAMPLE — registration cancelled without reasons

Facts. Z, a registered breeder, has his registration cancelled by the Authority without any reason being given. Can Z challenge it?

Rule. The Authority exercises quasi-judicial power; principles of natural justice (audi alteram partem — hear the other side, and give reasons) apply. An appeal lies to the Plant Varieties Protection Appellate Tribunal (originally; functions later reorganised).

Apply. Cancelling a valuable right without notice, hearing or reasons violates natural justice and is void.

Decoy. The Authority’s power to cancel is real, but it is not unfettered — it must be exercised fairly.

Conclusion. Z succeeds; the order is liable to be set aside for breach of natural justice, and he may appeal.

💡 EXAM TIP — the “authority acted unfairly” problems

The trap. Candidates argue only on the merits of the variety and miss the procedural point.

What to write. Name the principle — natural justice (notice, hearing, reasoned order) — and the appeal route; state that even a valid power must be exercised fairly.

Why it scores. These problems are planted to test procedure, not botany; the marks are in “no hearing / no reasons = void, appealable”.
