Compensation to Communities
Behind many a modern variety lies a village that quietly conserved the parent landrace for generations. The Act does not forget them: s.41 lets any person claim compensation on the community’s behalf, so that the group — not just the individual breeder — shares in the value it helped create.
Community compensation — s.41
Under s.41, any person, group of persons, or a governmental/non-governmental organisation may, on behalf of a village or local community, file a claim that the community has contributed to the evolution of a variety registered under the Act. The Authority then:
- verifies the claim after notice to the breeder and an opportunity to be heard;
- determines the compensation payable, having regard to the extent and nature of the community’s contribution; and
- directs the amount into the National Gene Fund (s.45), from which it is disbursed.
This is a collective right — distinct from the individual breeder’s benefit-sharing — recognising that genetic improvement is often a community achievement.
Section 41(1): “Any person … or any governmental or non-governmental organisation, on behalf of any village or local community … may file [a claim] … in respect of any contribution … in the evolution of any variety …”
In Simple Terms: If a community’s efforts helped create a registered variety, someone can claim money for that community under s.41. The Authority fixes the amount and pays it through the National Gene Fund — the community’s collective share of the benefit.
🧩 WORKED EXAMPLE — a village’s contribution to a variety
Facts. An NGO discovers that a newly registered variety was bred from a landrace long conserved by a tribal village.
Rule. s.41 — an NGO may claim compensation on the village’s behalf for its contribution; the Authority determines and awards it into the Gene Fund.
Apply. The NGO files the claim; the breeder is heard; the Authority quantifies the village’s contribution and directs compensation to the Gene Fund for the community.
Conclusion. The village receives collective compensation through the Gene Fund — the Act’s recognition of community contribution.
