Breeders’, Researchers’ and Community Rights

A registered variety, like any IP, gives its owner an exclusive right. But the PPV&FR Act tempers that monopoly at both ends — researchers may freely use the variety to breed further, and communities may claim a share. The recurring “agent sues as breeder” problem tests who actually holds the right.

Three kinds of right

A. Breeders’ rights — s.28

The registered breeder (or his successor/agent/licensee) has the exclusive right to produce, sell, market, distribute, import or export the registered variety. He may authorise others by licence and may sue for infringement (topic 10).

B. Researchers’ rights — s.30

Any person may use a registered variety for conducting experiments or research, and as an initial source of variety for the purpose of creating other varieties — without the breeder’s permission. But if the registered variety is needed as a parent line for repeated commercial production of another variety, the breeder’s authorisation is required. This “research exception” keeps plant breeding open.

C. Community rights — s.41

A community (village or local community) that has contributed to the evolution of a registered variety may, through any person/group/NGO, claim compensation from the National Gene Fund; the Authority determines and awards it (topic 7).

D. Standing to sue

Only the registered breeder, his successor, agent or licensee may sue for infringement. A mere agent claiming to be the breeder has no standing to sue “as the breeder”.

Section 28(1): “the breeder … registered … shall have the exclusive right to produce, sell, market, distribute, import or export the variety.”

In Simple Terms: The breeder gets the exclusive commercial right (s.28); researchers may freely use the variety to breed new ones (s.30); communities that helped evolve a variety may claim compensation (s.41). Only the real breeder/owner (or a properly authorised agent/licensee) can sue.

🧩 WORKED EXAMPLE — the agent who sues “as the breeder”

Facts. An agent of a registered plant variety wants to institute infringement proceedings in his own name, as if he were the breeder.

Rule. s.28 read with the infringement provisions: the exclusive right and standing to sue belong to the registered breeder/owner (or his successor/licensee). An agent acts for the breeder, not as the breeder.

Apply. The agent is not the registered breeder; suing in his own name, claiming to be the breeder, misstates his capacity. He may sue only if duly authorised and in the proper (representative) capacity.

Decoy. Being an “agent of the variety” sounds like ownership; it is not — agency is not proprietorship.

Conclusion. The agent will not succeed in suing as the breeder; he lacks standing in that capacity.

⚠️ DON’T CONFUSE — breeders’ right vs researchers’ right

The breeder’s right (s.28) is a commercial monopoly — produce, sell, import, export. The researcher’s right (s.30) is a freedom to use the variety for experiment and as an initial breeding source without permission — but NOT to repeatedly use it as a parent line for commercial production. Do not say the breeder can stop all research: he cannot; s.30 protects the researcher.
