National Gene Fund

Where does the money for farmers’ rewards, community compensation and benefit-sharing actually come from? One pot — the National Gene Fund. It is the financial heart of the whole Act: money flows in from breeders and access-users, and flows out to the farmers and communities who conserved the genetic wealth.

The National Gene Fund — s.45

The National Gene Fund is constituted under s.45 and administered by the Authority. Learn its sources and its uses — that is exactly what the short note asks.

A. Sources (money in)

• Benefit-sharing amounts (s.26).
• Annual fees payable by holders of registered varieties.
• Compensation deposited under s.41 (community claims).
• Contributions, grants and donations from national and international organisations and other sources.

B. Uses (money out)

• Benefit-sharing payments to breeders/persons entitled.
• Compensation to farming communities under s.41.
• Reward and recognition to farmers/communities who conserved/improved genetic resources (s.39).
• Support for in-situ and ex-situ conservation of genetic resources, and for strengthening capabilities of Panchayats/institutions in conservation.

Section 45(1): “The Central Government shall constitute a Fund to be called the National Gene Fund …” into which benefit-sharing, annual fees, compensation and contributions are credited.

In Simple Terms: The Gene Fund is the Act’s single money pot. In come benefit-sharing, fees, community compensation and grants; out go rewards to farmers/communities and money for conservation. It turns the Act’s promises into actual payments.

🧩 WORKED EXAMPLE — tracing a benefit-share through the Fund

Facts. A company registers a variety derived from a farmers’ landrace; the Authority orders benefit-sharing.

Rule. s.26 benefit-sharing and s.41 compensation are credited to the National Gene Fund (s.45), from which the community/farmers are paid.

Apply. The company’s benefit-share goes into the Gene Fund; the Authority disburses it to the contributing farmers/community.

Conclusion. The Gene Fund is the channel that carries value from the breeder to the conservers.
