ESI Benefits and the Medical Benefit Council

An insured worker breaks his leg on the shop floor. From that moment ESI can do four things at once: treat him free, pay him a cash allowance while he cannot work, compensate him if the leg never fully heals, and — if the injury had killed him — pay his family. One contribution, a fan of benefits.

The six benefits, and the body that advises on medical care

Section 32 lists the benefits an insured person (and, for some, his dependants) may draw:

  1. Sickness benefit — periodical cash payment during certified sickness, for a limited number of days a year (with extended sickness benefit for certain long-term diseases and enhanced sickness benefit tied to family-welfare).
  2. Maternity benefit — periodical cash payment to an insured woman for confinement, miscarriage or sickness arising from pregnancy.
  3. Disablement benefit — cash for an employment injury: temporary disablement benefit while the disablement lasts, and permanent disablement benefit (for life) where earning capacity is permanently lost.
  4. Dependants’ benefit — periodical payment to the dependants of an insured person who dies from an employment injury.
  5. Medical benefit — full medical care in kind (out-patient, in-patient, specialist, medicines) for the insured person and his family.
  6. Funeral expenses — a lump sum toward the funeral of a deceased insured person; some schemes add confinement expenses.

The Medical Benefit Council is an advisory body to the Corporation on the administration of medical benefit — the certification of sickness, standards of medical care, and complaints against medical practitioners. It advises; it does not run the fund.

Section 32, Code on Social Security 2020 (in brief): insured persons, their dependants or others “shall be entitled to … (a) sickness benefit … (b) maternity benefit … (c) disablement benefit … (d) dependants’ benefit … (e) medical benefit … and (f) funeral expenses.”

In Simple Terms: Sickness pays you while ill; disablement pays you (or your family, as dependants’ benefit) for an injury at work; maternity pays an insured woman; medical benefit treats you in kind; funeral expenses bury you. The Medical Benefit Council is the advisory voice on medical care.

🧩 WORKED EXAMPLE — one accident, several benefits

Facts. An insured factory worker suffers an employment injury that keeps him off work for two months and leaves a permanent limp.

Rule. For an employment injury, ESI gives medical benefit (treatment), temporary disablement benefit (while off work) and, for lasting loss of earning capacity, permanent disablement benefit.

Apply. He is treated free (medical benefit), paid a cash allowance for the two months (temporary disablement), and assessed for a permanent disablement pension for the limp.

Conclusion. The same event triggers a stack of benefits — say which benefit answers which need.
