Facts.
The accused inflicted a single spear thrust that penetrated the abdomen; the victim died.
Issue.
What must be proved to bring a killing within s.300 “thirdly” (murder by an injury sufficient in the ordinary course of nature)?
Held.
Four things: (i) a bodily injury present; (ii) its nature proved; (iii) the injury was intended (not accidental); and (iv) the injury was objectively sufficient in the ordinary course of nature to cause death. If all four are shown, it is murder, regardless of whether the accused intended death.
