Powers and Functions of the Tahsildar

The Land Reforms Act is full of grand ideas — vesting, conferment, ceilings — but someone has to make them happen on the ground, field by field, dispute by dispute. That someone, for most day-to-day matters, is the Tahsildar: the taluk-level revenue officer who fixes rents, decides small tenancy disputes, recovers arrears, and carries out the orders of the Land Tribunal. A question on the Tahsildar is really a question on the Act’s front-line machinery.

Who the Tahsildar is, and what he does

The everyday picture: the Tahsildar is the executive and quasi-judicial officer at the taluk level, the first port of call under the Act. He is not the Land Tribunal (which decides occupancy/ownership claims and is chaired by the Assistant Commissioner) — in fact the Tahsildar is the Tribunal’s Secretary — but on his own he carries a substantial list of statutory functions. Be careful to give his Land-Reforms-Act functions specifically, not his generic revenue duties.

In Simple Terms: The Tahsildar is the workhorse of Part B — he settles the smaller money-and-possession questions between landlord and tenant, and he executes the bigger decisions the Tribunal and the Deputy Commissioner take.

A. The Tahsildar’s functions under the Act

Group them so they are easy to reproduce:

  1. Rent matters. He determines disputes about the rent payable (s. 9), orders the refund of rent wrongly recovered and imposes penalty (s. 11), and may reduce the rent where the land is damaged by flood or other cause beyond the tenant’s control (s. 13).
  2. Recovery of rent (s. 33-type function). A landlord’s claim for rent must be made to the Tahsildar (not a civil court); he holds an enquiry and orders payment, the application being filed within one year of the rent falling due.
  3. Possession and eviction. He orders restoration of possession to a tenant or agricultural labourer, and no landlord may recover possession except under an order of the Tahsildar; he applies the relief-against-forfeiture rule before ordering eviction for arrears (Topic 2).
  4. Conferment machinery. After the Tribunal registers a tenant as occupant, the Tahsildar determines the “amount” payable to the landlord and apportions it among the landlord, intermediaries and encumbrance-holders (s. 48), referring any question of law to the civil court.
  5. Ceiling machinery. He receives declarations of holdings, imposes penalties for failure to declare or for false declarations, and takes possession of surplus land vesting in the State.
  6. Soldier/seaman resumption. He decides applications for eviction and delivery of possession where a soldier or seaman resumes land.
  7. Management of surplus land. He manages the surplus lands (by lease or other arrangement for cultivation and protection) until they are granted away.

⚠️ DON’T CONFUSE — the Tahsildar and the Land Tribunal

They are different bodies with different jobs, and swapping them loses marks:

  • The Land Tribunal (s. 48) — a collective body (Assistant Commissioner as Chairman + four members, one SC/ST) that decides the big status questions: whether a person is a tenant, whether land has vested, and who is entitled to be registered as an occupant (owner).
  • The Tahsildar — a single officer who handles the executive and smaller quasi-judicial work: rent disputes, refunds, rent reduction, recovery of rent, restoration of possession, determining and apportioning the “amount”, ceiling declarations and penalties, and managing surplus land.

Remember the link: the Tahsildar is the Secretary of the Tribunal, so he serves it — but the decision to confer ownership is the Tribunal’s, not his.

🧩 WORKED EXAMPLE — the tenant deposits rent with the Tahsildar

Facts. A landlord refuses to accept his tenant’s rent and refuses to give a receipt, hoping to build a “default” case for eviction. What can the tenant do?

Rule. Where the landlord evades receiving rent, the tenant is deemed to have paid if he sends it by postal money order to, or deposits it with, the Tahsildar (s. 9); the Tahsildar also determines any dispute about the rent payable.

Apply. The tenant deposits the rent with the Tahsildar. In law he is now treated as having paid, so the landlord cannot later claim two years’ default; if there is any dispute about how much is due, the Tahsildar decides it.

Conclusion. The Tahsildar’s power to receive deposited rent and settle rent disputes defeats the landlord’s manufactured “default” — a good illustration of the Tahsildar as the tenant’s front-line protector.

Case Laws

  • Smt. Lalitabai vs State of Karnataka (1995) — the Tahsildar has no power to decide whether land has vested under s. 44; that is for the Land Tribunal, and a Tahsildar’s vesting order is void — marking the limit of the Tahsildar’s authority.
  • Totawwa vs Revanappa (1980) — powers under the Land Reforms Act are confined to the officers the Act names; a police officer has no power under the Act to interfere with civil rights or trench on the Land Tribunal’s jurisdiction.
