Mackinnon Mackenzie & Co. Ltd v Audrey D'Costa (1987)

Labour Law I · Equal Remuneration

Facts.

Lady stenographers were paid less than male stenographers doing the same work.

Issue.

Does paying women less for the same work violate the equal-remuneration law?

Held.

Women doing the same or similar work must be paid at the same rate as men; the pay difference on the ground of sex was struck down.

Why it matters.

It is the classic application of “equal pay for equal work” and the equal-remuneration guarantee now in s.3 of the Code.
