Preamble

The most famous preamble in Indian law is the Constitution’s — “We, the People of India…” In Kesavananda Bharati v State of Kerala (1973), the Supreme Court used that preamble as a key to the Constitution’s basic structure. If the preamble can help unlock the supreme law, it can certainly help unlock an ordinary Act. But it has a strict place in the queue — it speaks only when the words are unclear.

What is the preamble, and how far is it an aid?

The preamble is the introductory part of a statute that states the reasons and objects for which the Act is passed — historically opening with “Whereas…”. It is the key to the makers’ minds: it tells the reader what mischief the Act was aimed at and what remedy it intends.

Its rules of use:

  1. A legitimate aid to intention. The preamble is a recognised internal aid. It expresses the general object and scope of the Act and may be used to understand the purpose and to resolve an ambiguity in the enacting words.

  2. It speaks only where the words are ambiguous. This is the crucial limit. Where the enacting words are clear and unambiguous, the preamble cannot cut them down or extend them. The preamble is called in only when a provision is genuinely doubtful — it is a tie-breaker, not a master.

  3. It cannot override a plain section. A famous formulation: the preamble is a good means of finding out the meaning of the statute, and a key to open the minds of the makers, but it cannot control the enacting part if that is clear. If preamble and plain section conflict, the section prevails.

  4. The Constitution’s preamble. After Kesavananda Bharati (1973), the Preamble is regarded as part of the Constitution and an aid to interpreting its provisions, though it is not itself a source of power or of any prohibition.

Principle (preamble): “The preamble may be resorted to in order to remove ambiguities … it is a key to open the mind of the makers, but it cannot be used to control or qualify the plain and unambiguous language of the enacting part.”

In Simple Terms: The preamble tells you why the Act was passed. Use it to understand the object and to settle a genuinely doubtful provision — but never to override words that are already clear. It is a key for a locked door, not a crowbar for an open one.

🧩 WORKED EXAMPLE — Preamble resolves a doubt

Facts. A section of a land-reform Act is ambiguous on whether it covers a particular kind of tenant. The preamble recites that the Act is “to provide security of tenure to all cultivating tenants”.

Rule. The preamble may resolve an ambiguity by revealing the object, but cannot override plain words.

Apply. Because the section is genuinely doubtful, the court reads it in light of the preamble’s stated object of protecting all cultivating tenants and includes the tenant in question.

Conclusion. The ambiguous section is read to cover the tenant, guided by the preamble’s object — a result the court could not reach if the section had plainly excluded him.
